Correction System Of The Illegal Acts

The system of labor education and rehabilitation came into being in the 50s of last century, which played a very important part in arranging employment together with consolidating the new-born regime. Due to that special era, there are inherent defects with this system both in the theoretical basis and in the concrete stipulations. So far the system has been changed a little, but the inherent defects can not be got rid of. On recognition of its historic and realistic rationalities, we think it necessary to transform it.After investigating similar systems abroad, this dissertation puts forward a proposal to reconstruct the system of labor education and rehabilitation, that is, treatments of injuria. Having defined the nature of the system of treatments of injuria, the author has clarified its object and measures. The theoretical basis has been established with the help of the theory of social defense and theory of due process. Aided by the logic supportings of social culture, this thesis has produced the framework of the system of treatments of injuria, establishing the fundamental principles of ruling by law, openness, justice and protection of human rights. Subsequently the author has made some practical conceptions with regard to the designing both its substantial and procedural systems, which may be helpful to the legislation of the treatments of injuria of our country.
