Since China opened its door to the world and established a market economy, a great number of small and medium sized enterprises(SMEs) have been established, and they have become an important part of the national economy . SMEs have had a major influence on employment and economic growth, but a significant bottleneck that has impacted their growth has been financing. To address the problem, a SMEs credit guarantee system was developed, which attempts to improve the ability of SMEs to qualify for and receive financing. Credit guarantee has become an important tool of helping SMEs get financial support from banks.In support of SMEs, developed countries have attached great importance to the development of laws designed to regulate the credit guarantee industry. Compared to these countries, significant improvements need to be made to our legal system.This article intends to analyze our current legal system of SMEs credit guarantee to find its shortcoming by making comparison with western legal systems, as well as to make research into the rules and regulations covering SMEs credit guarantee that have already taken effect in China. Learning from western legislative experience, the article has put forward some ideas and proposals that may benefit the development of our own system of laws governing SME credit guarantee, helping to complete its legal structure ,rules & regulations and the relevant measures. Specific proposals are made regarding laws of supervision ,social credit system ,risk management ,loss compensation and ect, with the intention to aid the study of the legal system of our own SMEs credit guarantee and the practice of credit guarantee .Thus, a SMEs credit guarantee system can better promote the development of SMEs in China , and its function as an economic lever can further the government's economic policies more efficiently.
