The Law Of The Land Use Right

The problem of collective property right in our countryside has always been crucial to the countryside development, and the reshuffle of property structure is especially as the most important aspect in new countryside construction. This paper is based on my investigation into a given basic unit of Chinese administrative division as Mizhuang village in Xiangfan, Hubei province, which is a village of my hometown. Then, I try to analyze the characteristic that the flux of property right system has presented in nowadays countryside, and further more, speculate on the underlying force of the flux. This paper has chosen depth interview to collect materials. During my investigation I always set a topic or basic scope for the interview first, then began a free talk with my interviewee, in this way I could read between their lines and got the implicative information. After a tough process of dealing with the information and materials I've collected, there comes some conclusion and points of view in the exigent subject as today's flux of property right structure in our countryside.This paper starts with the construction of property right system. Then according to my empirical work in investigating the flux of property right structure in Mizhuang village which located in Xiangfan's high and new technology industrial development zone, it analyzes the structure of land's property right system, which has been regarded as the core of property right structure in countryside. Through case studies on change of property right, it also analyzes the form and feature of the property right's external transfer in our countryside, which aims at discovering the defect in it and finding the countermeasures.The reorganization of property right structure under collective ownership is essentially a key link of building a new socialist countryside. And the reorganization of economic basis will influence the form of social organization and countryside governance structure, in some manner, this can also be regarded as a progress that modernization has made in our countryside. From fixing farm output quotas on a household basis in earlier reform, till today's tryout of establishing collective joint-stock system and reforms of taxes and administrative charges in rural areas, our government had shown its strong determination and steady attitude in system reorganization. After all, I hope my empirical work in the country side could do a positive knowledge accumulation for solving the problems facing China's agriculture, rural areas and farmers.
