Reform The Subject Of The Rural Collective Land Ownership With Theories Of Civil Law

This issues concerning agriculture,rural areas and farmers have become the crucialissue that is influencing the social development of our country.From the perspectiveof the civil law, this issue concerning agriculture, rural areas and farmers are actuallyabout the problem of rural collective land ownership, because the rural collective landownership is both the right directly related to farmers and the important civil lawsystem concerning agriculture and the development of rural areas.The rural collectiveland ownership is a civil law system which has a wide range,and can be studied fromvarious angles.In order to provide a feasible scheme for the perfection of the systemof collective land ownership, this article mainly starts with the main body ofcollective land ownership system, Put forwarding the train of thought that reformingthe main body of collective land ownership to the form of a legal person.This thesis isdivided into three parts, excluding introduction and conclusion.The introduction delimits the writing background and the scope of this thesis.Chapter one is about the forming and defects of the rural collective landownership,outlining the reason of the defects of the rural collective landownership,pointing out that the defects of the body is the main defects.Chapter two is about different theories of the system of collective landownership,including nationalization plan,private ownership plan and other plan.In theend we come to a conclusion that reforming the main body of collective landownership to a legal person is the best plan.Chapter three demonstrates that rural collective land system should be replaced byrural legal person’s land ownership. The thesis demonstrates that formulating rurallegal person should take the juridical association in civil law in our country as itsbasis imitating the managing structure of corporation legal person.The conclusion finally summarizes the positive effects of the joint stock legalcooperative.
