As the world economy has entered into a knowledge-based economy era, intellectual property right appears to be increasingly complicated. With the broadening of the scope and the deepening of the meaning of the right, there exists a more significant possibility of the overlap and conflict between each IPR, for the border of IPR is originally unobvious. However, the backwardness of the current IPR legislation has resulted in the difficulties in the right enforcement and protection on the principle of interests balance. Therefore, several pairs of typical conflicts of IPR with trademark right centered are selected for a detailed elaboration in the purpose of exploring the basic legal principles and offering feasible suggestions for the conflict resolution, and in the hope of benefiting our IPR legal system optimization.
