On The Privacy Of Public Figures

As economy and civilization of human society develop,while independence,freedom and dignity of individuals are attached more find more importance to,privacy right which is a new kind of personal right appears.Privacy right is a very important'type of civil rights in modem society.Its development is the important characteristic of modem social advancement and the important symbol of modem civilization.Nowadays, cases of privacy right infringement tend to increase.Thus people require more about the protection.However,there are not so many theoretical researches on privacy right of public figures in our country,and most views unilaterally emphasize the restriction thereof,which cause many problems to judicial practice.Public figures as a special social group,their privacy right is quite unique,thus the research thereon has very important theoretical and realistic meaning.As for public figures' privacy right, essential restriction shall be set up,but such restriction shall not be extended without any limit,and shall be given appropriate protection instead.This dissertation researches and discusses the definition of public figures and crucial content of their privacy right.Through the analysis of the basic principle that public figures' privacy right shall be restricted and the current situation thereof,views concerning protection for their privacy right are put forward.This dissertation mainly compares and analyzes the privacy right of general public and public figures,as well as the current situation of protection for public figures' privacy right,and constructs the legal system of protection for privacy right from aspects of legislation and judicature,and provides suggestions regarding legal protection for public figures' privacy right:first,to ascertain the definition of public figures; second,to formulate provisions of protection scope of public figures' privacy right;third,to severely control foregoing protection scope;forth,to establish facts and reasons of defense in relation to public figures' privacy fight.
