It is the product of the opening policy for the legislative system of the special economic zones in China. China has got special economic zones for more than 20 years, and for the years, the government has tried and explored a lot in the establishment of the legal system to adapt to the export-oriented market economy. It is one of the legal systems for the legislative system of the special economic zones. In this paper, the writer uses of the knowledge of jurisprudence and the principle, recalls the history of special economic zones and inspects today, summarizes the unique features and common regularities of five special economic zones (Shenzhen, Zhuhai, Xiamen, Shantou and Hainan), explores the backgrounds of coming into being for the legislation system of the special economic zones in China, studies development and trend for the legislative system of the special economic zones in the new situation, and advances forward-looking thoughts. Through theory and empirical analysis of the special economic zone legislation, the writer studies how to give full play to the superiority of the legislative system, to resolve the problems properly, and to make good use of the legislative sufficiently and flexibly in order to promote the comprehensive development of urban construction.The whole paper is divided into four chapters. The first chapter analyses mainly the concepts of the legislative system of the special economic zones in China and the characteristics of its legislation. Chapter Two focuses on the history of the development and the significance of the special economic zone legislation in China and clarifies the development and trend for the legislative system of the special economic zones in the new situation. Chapter Three studies the nature and principles of the legislative power, that is, of legality, propriety, timeliness and flexibility, the four principles. Chapter Four sets forth the existing problems and solving ideas for the legislative system of the special economic zones. It focuses especially on the requests for the special economic zone legislation when we become the member of the WTO, and the problems to strengthen the private enterprises in the special economic zones and legislations on the tourist trade, and so on.
