On The Field Of Information Privacy Protection Of The Law

With the extensive deepening of the information field, people's way of life and their life habits are changed imperceptibly. They depend on the information increasingly. The opening and freedom of the information field brings unprecedented challenges to the personal privacy. In the information society, the space and scope of people's contacts is extended quickly, which makes the private space narrowed step by step. People enjoy the convenience brought by the modern information, meanwhile, they have got unexpected trouble, for example, the bank account number will be stolen; the mobile phone number will be used by the ill people; etc.. The offending of the personal privacy is one of the issues, which becomes more and more prominent, serious and intensified day by day. Though the beginning of the Internet and its relative information industry is comparatively late, it develops quite rapidly. Therefore, it's urgent to strengthen the protection of personal privacy.This paper is formed by five chapters besides the foreword. In this paper, the author analyzes the various characteristics of the offending of the personal privacy in the information field and its responsibility constitution. The author also proposes some measures to carry on the legal protection of the personal privacy in the information field in China, in the light of the protection law home and abroad. Chapter 1 discusses the concept of the personal privacy first, and then it analyzes the necessity of the personal privacy in the background of information. Chapter 2 states the present situation of the offending of the personal privacy in the information field and explores its characteristics. Chapter 3 analyzes the responsibility constitution of the offending of the personal privacy and lists all kinds of performance of the offending, such as disclosing the user's privacy, obtaining the information illegally, sending the spam or the SMS, as well as publicizing or sale others' personal privacy. Chapter 4 studies the law of the personal privacy protection, analyzes the present situation of privacy protection law in China, and then evaluates its development in China, and finally it points out the protection of personal privacy in the information field. Chapter 5 explains the inadequate aspects of the personal privacy protection in the information field in China from the point of view of the reality, it points out the existing difficulties of the traditional legal protection and the problem that needs to be solved, based on the above, it puts forward some suggestions on setting up the protection system of the personal privacy in the information field in China.
