Recidivism In The Criminal Law Research

Recidivist system plays an important role in criminal law, it also has a very important position in penology and criminal jurisprudence. It's has been 30 years since the recidivism provisions were first formulated in the Criminal Code of 1979 and almost no any change has taken Place except the length of time between the two crimes committed by recidivist has been extended to 5 years. The current condition of recidivist system is not parallel to its status in criminal jurisprudence, hence the recidivist system can not adapt to the changing criminal legislation and judicial practice. Discussionson key points of recidivist system will be done in the thesis, and some proposals will be put forward in order to benefit the alternation and perfection of the recidivist system in our country.There are four parts in the thesis. Part one :Describe the development biref history of Chinese and foreign recidivist's systems and the theoretical foundation of recidivist's system;Part two, Describe the recidivist's concept, important composing conditions of recidivist. Part three , this part makes analysis about the punishment principles of recidivist. Part four, this part points out some shortages of the recidivist system in our current criminal law and puts forward corresponding perfect suggestion.
