Insurance Policy Effectiveness Studies

The dissertation begins with the analysis of the nature of policy, draws a conclusion that policy is the evidence of insurance contract, and one of the written forms of insurance contract. Then, on the basis of this conclusion, the dissertation combines the legislation of different country and the practice of insurance in China, uses the provisions and cases in Civil Law and Common Law for reference, and probes into the effectiveness, invalidation and recovery of the policy. The dissertation consists of four chapters, more than 32,000 Chinese characters.Chapter I mainly analyzes the relation between policy and insurance contract, the relation between policy and insurance slip, by referring the provisions related with policy in Civil Law and Common Law, and the role of policy in conclusion of insurance contract. The policy includes all provisions which agreed in the insurance contract, and it is the voucher of the contract.Chapter II probes into validation essentials, entry-into-force time, and the significance of policy. Delivery is the necessary element for a policy entry-into-force no matter what kind of policy it is. But for the life insurance policy, insurance premium is also the necessary element.Chapter III probes into the grace period, the causes and effect of invalidation of policy. The invalidation only exists in the life insurance in my opinion, and the direct reason is that the installment insurance premium is not paid until the grace period passed.Chapter IV probes into the substance and form conditions, the character of recovery policy and the effect of it. Before the recovery, the insurance applicant must fill the application slip. The most important factor for recovery is insurability of the insurant.The last part is the conclusion of the former four chapters. When expresses my viewpoint, I talk about some other issues related with the effectiveness of policy which not involved in this dissertation.
