Our Judges Assistant System Construction And Perfect

It is a necessary path to establish the judge assistant system and to distinguish between the job responsibility of the judge and the judge assistant. As a correlated measure to the construction of professionalism of the China judge, the system also is a precondition to maintain the elitism of the China judge and to realize the justice and fairness in society. To establish and prefect the system, we should attach importance to sort out many different relations in courts, and to solve the problem of conflicting and coordinating between it and the current systems.This thesis is divided into six Chapters. Chapter 1 briefs the origin of the judge assistant system in both Chinese and western perspective, and discusses generally the development process and the reason why the system is important to us.After a deep research into the similar system of the main western country, Chapter 2 produces the system' s four main values, e.g., to promote the judicial justice and efficiency, in a view to borrow successful experiences from them for the benefit of our system construction.Chapter 3 makes a positive research into the detailed operation of five pilot courts in China and tries to analyze the gain and loss thereof in order to bring out the necessity of the system construction.Chapter 4 lays out the detailed arrangement of the system in question, among them covers the problems of role orientation, origin, assessment, qualification, job responsibility, promotion, etc, of judge assistant.Chapter 5 discusses the operation and function of the judge assistant system in different stages of the civil procedure, combined with some practical cases, and especially the role of judge assistant in the preparative stage before the court.The last Chapter aims at the efficient coordination of the system in question and current related judicial systems, including the judge system like the organizational law of the People' Court, the civil procedure law, the management system of court clerk and the operation system of full court, in order that the system can function healthily and effectively.All things discussed above are supposed to benefit the construction and improvement of the judge assistant system in China.
