This article (paper) mainly focuses on the topic of criminalization and decriminalization of the victimless crime. Starting with the background of the theory of "victimless crime" , the author expatiates the defining and commentary of academic circles regarding with the concept of the theory and develops his own opinion of it: activities committed out of human nature violating religion or morality, possessing no infringement or threats to legal interest under the protection of Criminal Law, resulting in no other direct victims except the actor, without impinging others personal or -property rights. Then analyses five main characteristics of the victimless crime and accordingly develops four reasons for decriminalization of it and six for criminalization which leads to author' s ultimate standpoint: Victimless crime which should be criminalized ought to be treated differently and separately from those could be decriminalized or mitigated ones. In the end, the author briefly analyzed issues in the following non-regulated victimless crimes: crimes concerning with prostitution, Obscene-Object-Offense, crimes of assembled licentious activities, gambling crime, drug crime, crimes targeting juveniles.
