With the development of victimology and the movement of protecting victims,Strengthening protection of victims with legislation has been becoming a tendency of criminal justice system on a global scale.The criminal victims are litigant participants whose legal rights and interests were infringed directly by crime. Criminal Procedure Law of the People's Republic of China,which was amended in 1996,pays more attention to criminal victims,and the victims have become the party of litigation and enjoy fairly numerous procedural rights.However the protection of victims' legal rights and interests is still defective.At present,there are some countries who have the contradiction pattern of the criminal procedure lawand the consensus pattern for solving dispute,this appearance also found in China,according to the contradictory unity theory,there must have contradiction and consensus between victims and criminal,and also between victims and the procuratorate as the accuser. Through the analysis of relation between those three modes,points out the defects of contradiction and consensus in the protection of victims,and absorb the forieign way ,then give some suggestions in protection of the victims' litigious rights.The first chapter is a comprehensive view of victims' concept and characteristic,find the shortcoming in Criminal Procedure Law. The second chapter analys carefully the contradiction and consensus between the victims,criminal and procuratorate.The third chapter introduce the litigious rights of victims,and the defect.The forth chapter introduce the forieign way.The sixth chapter gives some suggestions in protection of the victims' litigious rights,including the rights of foundation, contradiction and consensus .
