Legal Economics Of The Public Prosecution System

Whether the public prosecution system comes in line with the rules for economics of law, will impact the justices and efficiency of the state prosecution. This article tries to use the economic theories such as economic man, transaction cost, game theory, and efficient employee incentives etc. to analyze the real issues in current China's public prosecution system, like positioning and examination of public prosecutors, organization system and interest distribution of public prosecution institutions etc. It aims to have the reform of public prosecution system undergoes in comply with the modern idea of law, i. e. fairness, justices and efficiency.
