The compulsory liability insurance system of vehicles, which has been widely enacted in many countries and regions of the world, has laid the foundation for safeguarding the interests of the victims of the traffic accidents.The Regulation on Compulsory Traffic Accident Liability Insurance for Motor Vehicles, adopted at the No.127 executive meeting of the State Council on March 1, 2006, failed to endow the victims the right of direct claim, which is indeed the regret of the legislation. For this reason, I write this thesis to contribute my standpoint that a comprehensive system of the right of direct claim for victims should be set up in the legislation.The structure of the thesis is as following:The primary coverage of the first chapter is the illustration of the basic theory of the right of direct claim. In addition, the writer attempts the necessity of such right.The second chapter introduces of the right of direct claim in other countries and regions of the world at present; and illustrate the comprehension for china legation.The third chapter is about the research of the right itself. In this chapter, the writer discusses six topics which have business with the right of direct claim. The main purpose of this chapter is to explain the true features of the right.The primary coverage of the final chapter is the legislative proposal. The writer believes that the right of direct claim is very important for the victim and therefore should be set up by china legislation. In addition, the writer also believes the supporting measures should be built in order to protect the interests of the victims of the traffic accidents. So the writer offers six legislative proposals about the subject.
