On The Job-related Crimes Investigative Measures

Being an important manifestation of the state corruption,official crime can cause significant damage to property,blemish the image of the government,and even imperil the stability of the state power,so it really deserves a forceful blow.In the light of whether or not the blow to official crime is powerful,and the action against it is effective, the most crucial factor is the result of investigation.With the development of science and technology,official crime becomes more technical and converter.So the mainly foreign countries give their investigating organs power making use of technical investigation.The United Nations also legislates "United Nations convention against Corruption" to below the official crime.However,the prosecutorial organization in China can not meet the need of investigating such crime due to its relatively simple and outdated means of investigation.On the basis of elaborating the concept and character of technical investigation,this paper analyses the reality and defect of technical investigation of official crime in China.Based on a comprehensive analysis of the advanced experience of foreign countries,the paper try to put forward some legislative proposals just as application subjects,application conditions,application procedures,the use of available materials and the protection of civil rights to improve the law about technical investigation of official crime of prosecutions in China,in order to improve the relevant legislations and combat such crime effectively.
