The theory of citizen moral character demonstated impormant promoting function during the historic process of the formation ,development and change of rule of law in the west Europe .Namely the shaping of citizen moral character promotes the formation of legal order. And it is the support of the legal order. Since the ancient Greece, the citizen moral character has been providing good intrinsic power for the system of states direct democracy, and then the primary legal order formed. Citizen moral character shaped with the help of the characteristics of European Middle Ages history, the booming of cities and 3R movement. Therfore, states formed and legal system of modern times developed. In China ,as a result of the traditional autocracy's dominant pattern and the social structure of combonition of nation and family as well as natural ecomony, Chinese has strong subject and peasent conciousness. That blocked the development of legal order. So, the shaping of citizen moral character is essential to Chinese legal order. On one hand, as the intrinsic impulse of legal society, citizen moral character is helpful to citizens'Civic Engagement, the right conciousness, freedom and equality. On the other hand, citizens'Civic Engagement, the right conciousness, freedom and equality restrict the abuse of nation's power and arbitrary decision. Thus citizens'freedom and rights can be protected effectively. Eventually, legal nation will be formed.
