Look Forward To The Possibility Of Theoretical Issues

The theory of anticipated possibility because of its strong humanities background,arised from Germany,and then popular in Europe and Asia ,as a "common wealth" of every country. but good theory does not necessarily represented good practice in every country , which also existed a lot of controversy and differences. In this paper,the author useing the comparative analysis methods, aims to explore the concrete application ways of the anticipated possibility in China. First, the article analyzes the anticipated possibility's theory origins, and clarifys its concept meaning and the bases of the theory; Second, after reviewing the theory status and criteria for judging's many opinions of the anticipated possibility, the author put forwards his own opinion, he think,in nowadays China,the anticipated possibility should be used as ultra-relief subject of criminal responsibility and should adopt the amended Actors standard to judge the possibility's existence and size; Finally,after analysis the necessity and possibility of the anticipated possibility's coming in China,the author put forward the coming's possible path.
