There are a growing number of our learners devoting to the study about the theory of anticipated possibilities. The meaning of this theory is that we cannot punish these people who do not have opportunities to choose the legal behavior. In these cases, people cannot ask them to be responsible for what they have done.The theory of anticipated possibilities has been introduced and argued for many years with very deep studies, this theory has numerous benefits. It is widely hold notion that our state’s criminal theory base on the constitution theory of crime as central. While constitution theory of crime require the unified of Subjectivity and Objectivity, it is necessary to clear out whether people’ behavior is accord to the constitution of crime which is the only standard of decide whether actors have to responsible for his or her acts.Currently, our country is in the special period with soaring criminal rate. Those who have no choice but to commit crime have to be placed mercy on, as they do not have much of the subjective culpability of the mind. If people punish them, this will be against the spirit of our humanity.The theory of anticipated possibilities aware the Freedom of will and focus on the humanity. There are lots of mutual theories about it in other countries. As the law worker we should not ignore the significance of this theory. If we make effort to introduce this theory in our country accordingly and make it possible to use in accordance with our realities of our country, then our criminal theory would benefit.
