On The Principle Of Public Interest In The Anti-dumping

Anti-dumping measures are allowed as the trade remedy measures according to WTO rules. The purpose of Anti-dumping system is to maintain the fairness of the market and protect domestic industries, but this system would have lots of negative impact when it was abused. Therefore, from the point of view of balancing the interests, we should restrict the abuse of anti-dumping measures and eliminate the negative effects they caused. The principle of public interests is the main tool to restrict the abuse of anti-dumping measures.This paper clarifies the concept of public interests and its legal and economic foundation in practice first. And then, after comparing the legislation and practice of the principle of public interests in Anti-dumping measures in European Community, Canada, the United States and WTO, this paper approve their advanced and mature approaches and do some research on the potential problems. Thirdly, the paper clarifies the factors considered in anti-dumping practices by analyzing some typical cases. Last, the current legislation and practice situation and some potential problems in China currently are discussed and some specific advices to improve the public interests in Anti-dumping measures are given.
