Access And Risk Legal Issues In The Energy Field Of International Investment

Under the background of economic globalization, international investment in the field of energy keeps developing since the demand of energy of each nation keeps increasing. Meanwhile, energy is closely related to national security since it plays a fundamental role in a nation's economic development. Consequently, the regulation of international investment in the field of energy is, to some extent, different from the regulation of international investment in other fields. This dissertation focuses on two most important issues in the regulation of international investment in the field of energy, i.e. market access and investment risk.The main body of this dissertation includes 4 chapters:Chapter 1 focuses of basic issues in international investment in the field of energy. This part will further introduce the legal framework of international investment in the field of energy after elaborating the basic meaning and main forms of such investment, so as to give readers an overall understanding of such investment.Chapter 2 concentrates on market access issues in the international investment in the field of energy. This chapter will begin with an introduction of the meaning and main contents of the market access in the international investment in the field of energy, then conduct a comparative study of some typical countries' regulation of market access in such investment. This chapter will end up with an analysis of the development trend of the international investment in the field of energy under the background of liberalization of investment access.Chapter 3 is an analysis and study of investment risks in the international investment in the field of energy. After analyzing the commercial risks and political risks in such investment, this part will provide some corresponding countermeasures.Chapter 4 elaborates some thought from the viewpoint of the international investment in the field of energy in China and/or carried out by Chinese energy enterprises. Facing the status quo of China's regulation of international investment in the field of energy, this chapter will provide some advices to perfect such regulation. Besides, based on the market access barrier and investment risks suffered in Chinese energy enterprises' overseas investment, this chapter will also provide some corresponding countermeasures.
