Under the policy of the “Belt and Road Initiative”,in recent years,Chinese enterprises have set off a new wave of overseas energy investment.However,China still has many difficulties in the prevention of overseas energy investment risks.As a result,enterprises are more likely to encounter risks when investing overseas,and face the problem of not being able to get timely relief when they encounter risks.In the field of overseas energy investment,the investment risks faced by Chinese companies include both political and non-political risks.Among them,political risks mainly include international political risks and domestic political risks of host countries;non-political risks mainly include environmental protection risks and maritime transportation security risks.At present,the relevant legislation on energy investment in China is not perfect,and there are few relevant international treaties and bilateral investment agreements signed.This makes it impossible for Chinese enterprises to fully protect their domestic and international laws when they encounter investment risks.To this end,China can learn from the legislative experience of the developed countries such as the United States and Germany in the field of energy investment,improve domestic energy investment legislation,and sign the Energy Charter Treaty as soon as possible,and do a good job in signing and improving bilateral investment agreements in order to Energy investment companies provide adequate and effective legal protection.At the same time,overseas energy investment companies should improve their ability to prevent investment risks and ensure the smooth progress of overseas energy investment.
