| Currently different opinions concerning the crime of accepting bribes co-exist, especially in the light of its determination. This thesis investigates several aspects of the above mentioned crime based on both Chinese foreign relevant laws. The thesis falls into four parts:Part one offers an exposition on the present situation and characteristics of crimes of accepting bribes. It analyzes the limitations to Chinese criminal laws and puts forward the perfecting of Chinese criminal legislation.Part two mainly focuses on sex bribes. The author demonstrated that the sex bribe is a form of bribery and should be criminalized. Furthermore, the analysis and definition of several cases of practices suspicious of sex bribes are offered in this part.Part three serves as an investigation into joint crimes of bribery. This part presents itself as a research into the joint crime of bribery, including the joint crimes between state functionaries, joint crimes between state functionary and non- state functionary. The determination of several kinds of joint crimes are proposed, consisting of the joint crimes of state functionary and his families and lovers.Part four is a discussion on completed and attempted crime of accepting bribes. First it studies the respective standards for the determination of completed and attempted crime of accepting bribes. Based on these standards, the author proposes the determination of new types of completed and attempted crime of accepting bribes, such as accepting carried interests, houses and cars without changing the ownership, accepting salaries for titular positions and sex bribe. |
