Theft Completed Standard Research

The problem of the standards of theft accomplished is always the focus of controversy among the Chinese and foreign theoretical circles of Criminal Law. Because theoretically a prevailing point of view can not be put forward. Thus in practice there are substantial differences between the standards of theft accomplished. It brings a lot of difficulties to judges and other members of the practical judiciary. Therefore, there is great practical significance in the study of the standards of the theft accomplished. This paper starts from the theory of criminal accomplished, introducing the theory of violation of legal rights according to the common law system, and using this theory to guide the general standard of theft accomplished. At the same time, the author uses the form of quoting cases, and the method of raising problems—analyzing problems—solving problems, to solve specific problems when defining the standards of theft accomplished in practice.
