An Empirical Study On The Accomplishment Of The Accomplished Theft

Theft ranks first in accordance to the incidence rate in the global.The crime of theft not only generates great threats to property rights of citizens but also results in enormous negative impacts on social order.Although the study on the crime of theft has been given continuous attention in the criminal law field of each country,to identify the accomplished crime of theft is still widely accepted as one of the most challenging dilemmas.This dissertation will be based upon control theory and combine theory with a large number of case studies with the primary objective of systematically identifying the crime of theft.Three parts will be explained in this paper:First,the theoretical foundation of identifying theft includes discussing the primary problems about the theory of crime especially in terms of theft.The identification of the crime of theft is supposed to take elements of crime and violated rights of law into consideration and accordingly analyze demerits and merits of different theories of identifying the crime of theft.To integrate common conditions of law practices is aimed at achieving appropriate theories of the identification of the crime of theft which is also named as "control theory".Second,the practices of identifying the general crime of theft involves combining applicable methods of control theory and studying the typical cases of general theft in the law practices.When identifying the general theft,the judgement should be in the light of the size,site,shape and character.Third,the practices of identifying the special crime of theft involves combining the objective features of special theft of legislative stipulation in the premise that the special crime of theft is also suitable for general crime of theft as consequential off-sense.Also,the identification of special crime of theft should meet the objective of committing the crime.in this premise,the identification could be achieved with the aids of control theory and the analysis of the typical cases in the process of law practice.
