On The Level Of China's Civil Litigation Jurisdiction System

In practice, China's current tier-jurisdiction system for civil suits has run into many difficulties, and could not take on challenges confronted by modern civil adjudication and dispute resolution system. The reason is rooted in the existing drawbacks of China's current civil suit tier-jurisdiction system on the positioning of court functions, jurisdiction standards and jurisdiction procedure. The reform and improvement of our current civil suit tier-jurisdiction system should not only consider the perfection of jurisdiction division standards but also the need to review systematic issues such as the scope of the preliminary examination court in tier-jurisdiction, the concept of tier-jurisdiction, and jurisdiction procedure and standards. Three measures should be taken for improvement: Review the court-adjudication function, and establish the distribution mechanism of court-hearings for civil cases; Establish an objective and standard combining case type, amount of subject matter and parties involved; Renew the review of coordination procedure of jurisdiction, and establish scientific administrative mechanism for jurisdiction.
