On The Perfection Of China's Civil Prosecution

China's civil procuratorial system is established according to the essence of the Constitution, which is the important constituent part of the procuratorial system and the civil action system. This system combines procuratorial system with civil action system, which not only reflects the restriction of procuratorial power to jurisdiction power, but also embodies the moderate intervention of procuratorial power to private right. Starting with the concept and characteristic of civil procuratorial system, this thesis analyzes the legislation of China's current civil procuratorial system, and compares a few typical countries' civil procuratorial system in the world. Integrated with China's practial condition, this thesis put forward the principle and channel of perfecting China's civil procuratorial system, and also discusses how to establish China's civil action system prosecuted by procuratorial organs and China's procuratorial supervision system of civil execution in detail.
