India is an old and mystical country. It had been an ancient India civilization. During thousands of years in ancient India, it subjected to foreign invasion, and shaped of variety of culture. In the modern times, India were ruled by the western countries, while the Indian people kept fighting against the colonization. During the two centuries of the colonization by the United Kingdom, great changes had happened in the politics, legal and education and other various aspects. The Indian people fought for the democratic rights and national independence, and founded the Republic of India, which is one of the biggest democratic countries in the world. The sample of the India has been concerned highly by the political science scholars.The relation of media and democracy is the core issues of journalism. India is an example which is worth thinking and researching. The media industry developed beyond the economic and social development. The volume of circulation of the Indian newspaper increased rapidly for years while the other countries went under through the depression of the newspaper. The media of India is famous for its dependence and freedom. It gains the advantage of the good tradition colonization period, and has great relationship with the India law system and the democratic progress. The media law reflects the relationship of the democracy, the rule of law and the media.The topic of the research is the media law development of India since1757. According to the time, the history is divided into five periods. During the period ruled by the British East India Co. and the period ruled the Britain, the media law of India was a tool of colonial rule, the India Penal Code (1860) has made clear for defamation and other related issues. In the period of the republic of the India, the Chapter 19 of the Indian Constitution became the basis for the rule of press law. The emergency period was the darkest period, the government curtail the freedom of the press severely. During the post liberation period, the press law became increasingly open and market-oriented.In each part, there is an comparison between the society development and the media advancement, in the cause of the introduction of the media. The media law of India basis on the common law system. Its sprits and the content both have an association with the history. Both of colonization and the democratic development branded on the media law system, therefore, the research is basis on the history and the culture, as well as the media development. The thesis starts with these aspects, aims at drawing the outline of the media law of the India.It seems that the complexity of India make the research more difficult, in the other side, it adds specific characters to the thesis. The thesis involves a lot of clauses of law which are bound up with the journalism of India. The background and the content of the articles, especially the great effect upon the media of India, have successful experiences of others developing countries.
