With the final realization of WTO frame and continuously decreasing of tariffs level, all countries begin to strengthen Non-Tariffs Barriers measures. Anti-dumping measures have been given more and more attention. All countries amend and supplement their anti-dumping legislations, and adopt anti-dumping measures frequently. Under this background, in order to seize back the missing market, the exporters try to circumvent anti-dumping measures thorough many methods. Anti-circumvention rules are made correspondingly to avoid these kinds of circumvention methods.China has been the country to which subject more anti-circumvention measures in the world than any others. International trade will be more prosperous because of further opening. In the face of growing international anti-dumping and anti-circumvention waves, adopting international trade rules and using of anti-circumvention rules, especially third country assembly circumvention rules rationally, become the issues which export-oriented enterprises have to research and resolve.In addition to the introduction and concluding remarks, the dissertation is divided into four parts:Chapter I: the concept and history of anti-circumvention. At first, the author expounds the concept of circumvention and anti-circumvention and makes the author's opinion after contrasting the definitions of circumvention between EC and United States. Then the author reviews the background of circumvention and anti-circumvention. Then, the writer describes the history about anti-circumvention of EC and USA, and the endeavor from GATT / WTO about international harmonization of legislation of anti-circumvention. At last, The author discusses various forms of circumvention.Chapter II: the third country assembly circumvention. Firstly, the author analyses EC anti-circumvention regime, especially about elements of third country assembly circumvention. Followed by analysis of rules about third country assembly circumvention in United States. Then the author interprets and discusses rules of third country assembly circumvention in Dunkel Text.Chapter III: The author compares the rules of third country assembly circumvention of EC, United States and Dunkel Text. Finally, the author summarizes the factors of constituting third country assembly circumvention.Chapter IV: In this chapter the author describes status quo of anti-dumping and anti-circumvention measures encountered by Chinese exporters. And then the author analyzes the causes of Chinese manufacturer being taken anti-circumvention investigation frequently. At last the author provides some countermeasures.
