With the rapid development of the tourism , it is urgent to build a legal system to adjust the tourism contracts in our country's. This dissertation is divided into three parts.In the first chapter the author analyses the concept and characteristics of the tourism contracts, rights and obligations of the parties,points out that the tourism contracts are agreements between the tour business operator and the tourists,which refer to the whole tourism schedule carried out by the tour business operator,and the tourism services including transportation,accommondition, dining and tour guides offered by the tour business operator, tuition paid by the tourists.In the second chapter,the author studies the amendment and termination of the tourism contracts from the aspects in which the disputes often occurs.The author holds that the tourists should have the rights to ask for compensation for mental damage and lost time.The tourism contracts belongs to typical consumer contracts,the Contracts Law of PRC. and the Law of PRC.on Protection of Consumer Rights and Interests both adjust the tourism contracts.The third chapter is about suggestions for the legislation for tourism contracts,which includes the macro guiding and fundamental principles and the micro designs for the legislation.The article is about 31,000 words.
