Evolution Of Chinese Rule Of Law In The Process Of Three Years: The Legal Function And Revelation

The issue of law function plays an important role in the study of law theory and law practice, but there is little correlative study about this question, and the relative systematic treatise I can find is "law function theory" written by professor Fu. Since the reform and opening-up in china, the law development in china has presented the time-phased characteristics. My paper is going to discuss some related questions about the transmutation of law function from its time-phased characteristics. That the Convening of the Third Plenary Session of the Eleventh Central Committee in 1978 made the authority and station of law was reestablished, and the onto function of law attained roundly construct. Since fundamental principle establishment of running the country according to law in 1996, people began to pay attention to the law function in the round. The Sixteenth Congress of the Chinese Communist Party was convened in 2002, and from then, to build a social democracy country under the rule of law has become our new aim, the law function began to advance toward the multi-demotions. At the present, constructing the social democracy harmonious society scientific proposition is put forward, the manner and range of law function is changing along with the continue reforming of economy and politics system. The author hopes to get some inspirations from the development of law function, and then do some things for the law construction of modern society.
