A Number Of Issues. Crimes Committed By Units For Study

With the development of economy, unit crime has been extended constantly. The problems the unit crime takes emerge clearly. Due to the time that the unit crime had been accepted by our legislature is brief, the pertinent legislations are not mature and the theoretic research is also not thorough and comprehensive. All that could not meet the requirement of the development of society and economy. By contraries, the unsubstantial theory should affect legislation and judicial practice, so we must do embedded research on some argumentative problems of unit crime to promote the theoretic research and the development of legislation and justice. On the base of other scholar's fundamental theoretic research in criminal law, this article begins with the conception and character of subject of unit crime, and recognizes some argumentative problems about subject of unit crime. For purity unit crime, the author gives emphasis to analyze the distribution of imputation and how to punish the natural person when he offends purity unit crime. The research of purity unit crime is propitious to recognize the unit crime completely and solve some problems of unit crime. All that will make up a blank. In the following chapter, the article introduces some representative theory about criminal obligation and finds their advantages and disadvantages, we learn their advantages and find the theory about criminal obligation which adapt to apply in our country and could solve our problems in developing process, In the end, the author learns some other country's advanced experience about theoretic research, legislation and judicial practice, put forward some proposal for improving unit crime. The author expects to do some help for improving our punishment system and promoting development of the legislation and justice.
