As an important part of property owners'autonomous agency, Property-Owners Committee (hereinafter referred to as "POC") plays a crucial role in management of property. Because that management of property is quite new in China, laws regulating POC are far from perfect, which, however, is of significant importance for the sustainable and healthy development of property market and the owners'vital interests. All those are the original intention of this dissertation.This dissertation consists of four chapters besides introduction and conclusion.In chapter one, on the basis of a comparison of the domestic and abroad legal status, the author points out the defaults of Chinese POC system. This chapter is composed of the study of the legislative and judicial situations of POC system in our country as well as in foreign countries, such as France, Germany, Japan, America, Taiwan and HK.In chapter two, by the analysis of the foundational theories and the development of POC in China, the author studies the legal status of POC by an historical way.In chapter three, to learn the legal status of POC more precisely, the author identifies and makes distinctions on the relationships between POC and other relative subjects, including property owners, owner convention, property management enterprises, and resident committee.In chapter four, the problems and difficulties that Chinese POC facing currently are studied, such as its vague legal status, tardy establishment, abuse of authority, lack of management outlay, ownership of property and so on. To each problem mentioned, the author gives suggestions that may be effective in solving it.
