The Probe On The Legal Status Of Realty Owners Committee

Owners' Committee is the management entity of the Condominium Owners. And also the significant part of the owners' autonomy management. However, the Owners' Committee is haven't any legal statue in the Chinese legal regulation. Meanwhile, there has contradictory between the Property Law, the Regulations of Property Management and the local administrative regulations. That's why the system of Owners' Committee has a lot of view by the people of all circles. In the present law system, owners committee hasn't any independent law status. This has led to many problems. And the system also can causing the owners can not set up their Owners' Committee, actually they haven't make good using of the authority by laws to protect their rights when the owner has established their owner committee. That also can make more inharmonious factors in the society.The author analyzes and illustrates the problems in the system of Owners' Committee, makes the comparison and link up the experience between the foreign countries, Taiwan, Hong Kong, Macao and China. Base on the situation and legal system of our country, this thesis would summarize the development ways that the legal statue of Owners' Committee in our country and the maturity suggestion of the system Owners' Committee.
