Gay Marriage Rights, Legal Regulation

Homosexuality, as a widespread behavioural pattern,has ever been in existence objectively,whether in the Western countries or in China,for thousands of years in huamn history.And for a long time, the gays have been confronted with the social pressures,discriminations or even severe persecutions.With the development and the change of our society, the human rights movement and the campaign for gay rights in some countries or regions have been developing step by step and perfected to a varying degree.The gays' fight for equal legal status for themselves and the call for the right to equal marriage have been on the rise.Homosexuality is no longer a cultural phenomenon in itself, but a social problem.Among other things, quite a few countries have officially recognized gay marriage by passing laws concerned,thus protecting the interests of the gays and quite a few countries even protect the marriage of the gays by making the laws concerned.However,in China it is still confusing about whether laws concerned should be made to protect the rights to gay marriage.This paper tries to find out how to protect the gays' rights to marriage to attain the goal of keeping social order by studying the status quo of the gays,the social comment and the equality of the rights to marriage.It is divided into five parts:The 1st part introduces the scientific cognition of the gays,namely a simple introduction to the implication of homosexuality, the status quo of the gays,the terms for homosexuality and how they come into being and the status quo of the gays both at home and abroad.The 2nd part gives an account of the same equal rights to marriage that the gays enjoy as the right to heterosexual marriage in terms of the essence and purpose of marriage;gay marriages and the relationship between homosexuality and gay marriages and comes up with the recommendation that gay marriage should be protected in our country by legislation.The 3rd part comes up with the problem of the legal protection of gay marriages,elaborates one by one the problems concerning the legislative protection of gay marriages abroad, as an indispensable part of the important theories involving the legislative protection of the gay marriages in China,meanwhile offering legally valid comments& analyses so as to guide the legislations concerning the gay marriages in our country to the right direction.It is essential to explore how to make laws concerning the right to gay marriage in our country and put forward further regulations concerning gay. marriage to keep stable the social order and end their inhuman life.What pattern of regulaltions to follow and how to define legally effective regulations etc play a significant role in China.
