Study Of The Tort Liability Of Internet Service Providers

In recent years, with the popularity of the network and the rapid development of Internet industry, a number of copyright violations as well as tort of privacy, reputation and other rights appear through internet, most of which are related to internet service provider(ISP).The difference from traditional tort is that the tort occurred on the Internet must use ISP service, which brought unprecedented challenges to the traditional legal system. The balance between people rights and ISP's rights has direct impact on the development of internet industry.In this paper, document analysis, comparative analysis and case study analysis are used. According to the characteristics of ISP, the author divides ISP into several categories and then studies the responsibility of them respectively. Based on the research of domestic and international legislative status, the author puts forward some suggestions in the hope of consummating ISP tort liability of Legislation.
