Taiwan Labor Standards Law Commentary

This essay discusses the Labor Standard Law of Taiwan and gives full description and analysis of its rules.The author has given her views on the Labor Standard Law of Taiwan based on the current society and the working environment by listing and analyzing the most rules of the law, including scopes and definitions, labor contract, salary, protection of the special populations, and occupational accident compensation. The paper has given comments on the rules respectively according to the development of labor relations and working environment that the Labor Standard Law of Taiwan has its advances in some rules but not all. Some rules are advanced enough for our new times and some are out of time waiting to be improved.The Labor Standard Law of Taiwan promulgated on July 30 of the year 1984 which is the most important law in Taiwan regulating the labor relationship. It establishes the minimum standard of working conditions and protects the rights of the labors by leading other labor laws.The first part of this paper introduces the making, modifying background and structure of this law. In the second part, the author summarizes the natures and features of this law. And the author comes to the conclusion that the natures of this law are replacement, compulsive, and general. In the third part, the author analyzes the main contents of the law by listing the articles respectively, including scopes and definitions, labor contract, salary, protection of the special populations, and occupational accident compensation. By judging the rules, the author gives her own ideas about the law. For the fourth part of this paper, the author summarizes the functions of the law and evaluates it giving her own ideas of the Labor Standard Law of Taiwan.
