| After the establishment of copyright of information and network in our country's Copyright Law, the protection system of the right of information and network was specified in the Protection 0rdinance of the transmission right of information and network. Our country's transmission of information and network and the protection of copyright has its own legal characteristics . From the angle that preserves the legal interest of the obligee ,Author researched the information and network infringement and the protection of copyright in the text which are also a main research direction that the jurisprudential circle is faced with .There are four parts in the paper: the first part, based on the summarization of the development of our country's network ,how to protect the network-related copyright under the existing legal system and the problems that exsit in the protection system of the right of information and network are put forwared. The second part , the author interprets the connotation of the copyright of information and network and the tortious forms of the copyright. The content of China's copyright of information and network currently includes network reproduction right, network distribution right, the right of network communication and so on , and on this basis a study on network infringement is expended. The third part, through indetifing the tortious acts of Copyright of information and network in China, the author respectively expounds juristiction of the tortious acts of copyright of information ,the construct of tortious acts, third-party liability of the tortious acts. The forth part, after analyzing the present situation of internet copyright infringement, we recognize that the tortious acts of network is so flooding is ultimately driven by the interests, and to protect the copyright interests of the rights holders, the legal relief is accordingly designed in the paper. |
