Chinese Women Inheritance Systems

To Protect the right of female property inheritance and improve the overall status of women is not only the one of the important topics of contemporary jurisprudence study, but a social problem in building a harmonious society course. Recalling the studies of Chinese inheritance system, we can easily find many of these studies are male-centered, women's lack of vision is logic, and is also a social and historical reality. The right of male property inheritance present a more static picture in China's inheritance system, change les'sly. But, when we turn to women's perspective, a dynamic picture of the unfolded before our eyes. In recent years, with the process of rule of law going on and improvement of the legal system constantly, the protection of women's rights attach importance in some degree, at the same time, the research of protection of special women groups'interests enter into the legal field gradually. The right of female property inheritance, especial some special women's right, are violated frequently, this phenomenon has brought unprecedented challenges to Chinese property inheritance system and also put forward new demands to improve the inheritance law.This paper is divided into three parts totally, the first part of the paper, to prospect the essence of development of Chinese female inheritance of property system and analyze the contemporary status and the reasons of Chinese female property inheritance system. The historical analysis of the phenomenon of women's inheritance and displaying the contemporary situation of women's inheritance rights protection and analysis of the reasons for the status quo, in the hope of raising people's awareness of women's inheritance rights protection and paying attention to the issues. The second part,in the base of the first part, from the system level, concentrate on analyzing the status of women's property inheritance system in China's civil system, with a feminist perspective, focusing on showing and profound analysis the defects of the legislative concept, specific system contents and the special groups protection system at current stage of China. The third part, to the phenomena and problems as well as the source of the problem raised before, to reference advanced foreign system and combine the practice of our country, try to provide some specific reasonable and feasible recommendations and system design for improving our female property inheritance system, hoping these have been helpful for protection of our women's inheritance rights and the enactment of the inheritance system in Civil Code.
