Legal Issues Of Protection Of Women's Right To Inherit Property

In recent years, with the constantly promoting of the process of the rule of law,and the continuously improving of the legal system, the protection of women’s rightshas been greatly enhanced and achieved remarkable results. But in reality, theinfringement of the women’s property inheritance rights still occurs. Suchinfringement may be visible or invisible, legitimate of illegitimate. This has broughtgreat challenges to China’s inheritance system, and also proposed requirements tofurther improve our inheritance law. Based on this, this paper would take Chinesewomen’s property inheritance rights as the research object, use the methods oftheoretical research and practical survey, do some thinking, combing and analyzingabout the related issues. Through the analysis of current situation on China’sprotection of female succession to property and legal problems, put forwardcountermeasures to improve our women’s property rights protection law.The article is divided into four sections which are female inheritance law of thehistorical background and the related legal system, Hong Kong and Macao, overseasfemale succession to property legal protection, China’s women’s inheritance rightsimplementation on present situation and the existence question, on the protection ofChina’s women’s inheritance rights advice. this article first reviews the historicalstatus of Chinese women’s property inheritance system, summarizes the presentsituation of the protection of women’s property rights and analyzes the reasons; thenbriefly introduces the laws and regulations on women’s property inheritance rights inHong Kong, Macao, TaiWan and overseas. Which has good reference for Chinastudies in the same problems; again researches the present situation of Chinesewomen’s property inheritance rights by two angles, rural women and urban women,and a comparative analysis of them; finally from the enhancement of women’sinheritance rights and the establishment of a sound legal system, such as the dwellingright system,the legitim system and the legal relief system. combined with the present situation of the protection of women’s right in China, and the learning from advancedlegislative and judicial philosophy and experiences of other countries.
