Social Construction Sight, The Cultivation Of The Civic Spirit Of The Rule Of Law

Bringing up the spirit of law, demonstrating that the construction of the rule by law in China is deepened from the level of a law system to the core of the spirit of law, sublimated from construction of a system of the rule by law to the stage of cultivating a culture of the rule by law, is very exciting to us. However, the situation that Chinese people do not possess the spirit of law generally is also frustrating. It is pretty urgent to the construction of the rule by law in China for cultivating all the citizens'modern spirit of law. But at the same time we can see the progress of the western rule by law states clearly that the gestation and the establishment of the rule by law and its spirit are not only based on the commodity-based economy and market-oriented economy, but also the interact result of dual structure between political state and citizens'society. Therefore, the cultivating of citizens'spirit of law in China should catch tightly the times pulse of"enforcing social construction"and"promoting the spirit of law", focusing on the isomorphism of two theory hotspots between social construction and the spirit of law to explore the new methods and new trains of thoughts on social construction in China.This article, instructed by the theory of Marxism, from the sight of social construction, with an emphasis on cultivating the citizens'spirit of law, synthetically using the method of combining critique with inheritance, combining theory with practice, and combining inference with practical evidence, giving a systematic argument into four parts on cultivating citizens'spirit of law in China and in the horizon of social construction.Chapter 1,from the angle of the deepen development of market economy and social contradiction exposed during the society transformation,I analyse the background the spirit of law raised, at the same time, through considering the argument on concept of rule by law among educational circles, analyse the connotation of rule by law under the view of history divided into old Greece ,recent times and modern times, summarize nine cognitions of the spirit of law in the recent educational circle, and formulate a scientific connotation of spirit of law.Chapter 2, I firstly distinguish four constructions which are easy to be obscured through the large ,middle and small three meanings. Then ,on the basis of commentary on various definitions of social construction made by international argument circle,I boldly propose a scientific connotation of social construction,thus interpret the mutual relatins between the spirit of law and rule by law, the spirit of law and social construction,and sum up the significant meaning made by the spirit of law.Chapter 3, according to the statistic,investigating and analysis,I grasp the present situation that citizens in the detect of spirit of law in China in the field of social construction, then conclude it into view,purpose,content three aspects, last I explore and argue the reasons of this detect condition from the following two views: traditional cultural passive factor of history extremely dispel the spirit of law, and undeveloped market economy in reality restrict the citizens'social development.Chapter 4,in the framework of citizen society theory,I explore and argue a new way to cultivate citizen's spirit of law in China from the aspects of state-market-society three dimentions.At the aspect of state dimention,I mainly testify the legislation,adminstration and judicature of society; at the aspect of market dimention,I focus on the testify of entrepreneur and enterprise two aspects; at the aspect of society dimention, I interpret four aspects closely relate to the construction of social organization.
