The Context Of Information Technology, "real Name" Legal Thinking

As a new kind of method which can solve the current social problems, the real-name registration system has been used in many industries of china, such as the real-name registration system of train tickets.But there are a loud sound in the society objected to the real-name registration system of telecom number and the real-name registration system of internet which aim to limit the spam message and purify the virtual space. And the main point is that these two systems associated with the fundamental civil rights and personal freedom of the citizens and privacy of citizens.This dissertation will focus on the opposite opinions about the real-name registration system of telecom number and the real-name registration system of internet, and try to find out the reasons of the opposite opinions through deep analysis.The basic principles of public law, such as the principle of public interest and the principle of law reserves and the principle of proportionality, will be used as the criterion to judge the rationality of the opposite opinions.In the first part of the dissertation, the background of the real-name registration system and the development of the two systems will be analyzed.And the characteristics of real-name registration system during the information-based society will be found out.In the second part, the dissertation will use basic principles of public law, such as the principle of public interest and the principle of law reserves and the principle of proportionality, as the main criterion to judge the rationality of the opposite opinions.In the third part of the dissertation, the methods to solve the contradiction between the good will of real-name registration system and the existed opposite opinions will be brought up.There are two innovations in this dissertation:the research about the new systems and the analysis based on the principle of public law.
