Research On The Principle Of Trust Interest Protection In Social Insurance Policy

Social insurance as the most important part of the social security system has gradually become an important part of our country’s government and local administrative organs at all levels. The social insurance law of the People’s Republic of China promulgated and implemented in July 2011, which caused no small impact on the social security system of our country since the founding of the PRC. Which takes the local social insurance policy of Shanghai as the representative, has produced many problems, and thus caused more administrative litigation cases. Through the analysis of these administrative litigation cases, we find that the principle of the protection of trust interests in social insurance policies has become a subject to be studied.Through the analysis of the meaning, origin and theoretical basis of the principle of reliance interest protection, the paper expounds the harm caused by the lack of social insurance policies in Shanghai, and classifies the missing types of the social insurance policies. At present, the principle of reliance interest protection is not universally applicable in social insurance policy, and there is a problem of the lack of the trust interests and the compensation mechanism of social insurance policies. The principle of reliance interest has many obstacles in the development of social insurance, the management idea of the traditional ruling government and the lack of legal consciousness, and the slow progress of the legal system. We must introduce the principle of the protection of reliance interest to the social insurance policy in the social insurance policy. I also believe that the principle of the protection of interests in the application of social insurance policies, such as how to define the trust interests, for the protection of the trust interests of the social insurance claims to apply for compensation, compensation, etc..
