An Analysis Of The Realistic Problems In The Reform Of Collective Forest Property Right System In China

Based on the real issues of reform of collective forest rights system in the presence of reflection and analysis, the only rural collective economic organizations to transform the joint-stock corporation. Through improving the relevant provisions of the rural collective economic organizations,the right of farmers can be protected effectively. However, in the writing process, some of the reform of collective forest rights system problems did not expect. In addition to these,there are other of the problems, but this article can not solve the problem by the rural collective economic organizations in the transformation of joint-stock corporation, so this paper did not put forward those. Therefore, the paper consider the reform of collective forest rights issues incompletely.Currently, the books specializing in forest right have been indeed published very few,and I read the book named "science of Forest right".There is information on the reform of collective forest rights system are some specific summary reform experience and the process of academic research,while The study of collective forest right system is no systematic.Academic journals and websites on the reform of collective forest right system have a lot of articles,but the angle of writing the reform of collective forest right is different. Academic definition of forest right to have each have their own statement,and the paper define forest right relating to forest right certificate in the law of the forest.Now that the development of collective forest rights in China is unique, the author describes the process of collective forest right system from the perspective of the historical development, so we can have a deeper understanding of collective forest rights system. Because the thought of the Three Powers Split and reform of collective forest rights system play an important role in the further liberation of the productive forces in rural areas, and the promotion of the development of forestry. Therefore, this paper analyzes from the three aspects of rural collective ownership, contractual right of land and land management right. In a practical point of view, this paper analyze the rural collective economic organizations, and contrast three forms in reality which replace it. So we should use the civil law with civil law thinking to solve the problem, and this is the effective method to solve the problems of forest right reform in our country. I think those problems can be solved from clearing ownership of collective forest rights, regulations on the development of rural collective economic organizations,improving the relevant laws of the village committee, national funds and policy support.
