The Tasks Of Building A Legal System Of Non-coastal Provinces In Bohai Sea Environmental Protection

Bohai Sea is a semi-enclosed shallow sea of China, semi-closed geographical environment determines that Bohai Sea is closely related to the production of human life, however, with vigorously develops of the Bohai economic circle, we see that the chemical contaminants of Bohai Sea are increasing, which led to the deterioration of water quality, marine ecosystem imbalance, frequent red tides and other major marine ecological problems.At late 90s of the 20th century ,the Bohai Sea environmental protection has become one of the tasks of national strategies, the State Environmental Protection Administration and State Oceanic Administration have also formulated the "Bohai sea Plan of Action Blue Sky "and" comprehensive improvement of the Bohai Sea program", with the three provinces and one city , some universities, research institutes and others.And so on, their research became to focus the quality of Marine environment's prevention, control and governance research,besides the main chemical pollutant emissions of the Bohai Sea.The conclusion afer Long-term theoretical research on the Bohai Sea environment protection and practical is: the law is an indispensable means in the protection of the environment of Bohai sea, there must be a legislative level to control the sewage,from the mouth to the coastal rivers, from the mouth of the River to the pollution sources upstream areas.There must be a strengthening legislation and a strict law enforcement. In this trend, the legislation on the subject of the Bohai Sea was officially put on the agenda.National Development and Reform Commission led the preparation of the "Bohai Sea Environmental Master Plan (2008 ~ 2020)" in 2009 ,which identified the key links and key areas.The Bohai Sea Environmental Protection Task is comprehensive, strategic, objective and endless, we must adhere to the principle of "sea and land co-ordination, balance between river and sea".The chemical pollutants in the Bohai Sea mainly come from land-based sources, sea and air source ,land-based sources are the important sources of pollution.land-based sources includs point source and surface source.the former can be divided into rivers and sewage outfall,which is the major source of various types of chemical pollutants; the latter mainly refers to the towns and villages, farmland runoff,which is the main source of the nutrients and COD. According to statistics,there are three major rivers including the Yellow River, Haihe River and Liaohe River flowing into the Bohai Sea.The three rivers include more than 80 rivers,in which there are more than 40 major rivers,and no one river is clean.The self-purification capacity of the Bohai Sea is limited, "if the water runoff of pollutants into the Bohai sea was fully put in place of management, the Bohai Sea environmental protection work will be completed 30% (Teng Zuwen" Bohai Environmental issues and Countermeasures ", therefore, it's a good way to control the water quality, fisheries, ecological problems of each river which flow to Bohai. each river is an ecosystem governance,so we should do overall comprehensive treatment,proceeding from the basin characteristics. At this level, the non-coastal provinces in the Bohai Sea should also be related to environmental protection legislation besides the Bohai Sea 13 provinces and cities.The non-coastal provinces include the Qinghai, Gansu, Ningxia, Inner Mongolia, Shaanxi, Shanxi, Henan and non-coastal cities and counties of Shandong in basin of Yellow River; Beijing, the non-coastal cities and counties of Hebei Province, Shanxi, Henan, , non-coastal cities and counties of Shandong in basin of Haihe River; Inner Mongolia and Hebei Province primarily in basin of Luan River; Hebei, Inner Mongolia, Jilin and the non-coastal cities and counties of Liaoning in basin of Liaohe River .This article begins from the present situation of Yellow River, Haihe River, Liaohe River,my objective is to prove the necessity and feasibility of responsibility of the non-coastal provinces in the Bohai Sea Environmental Protection.I will look for all laws about Bohai Sea Environmental Protection from the basins of three rivers,including Central law and local law. After this,I will compare these areas to identify the advantages and disadvantages in law enforcement and in executing of law.At last, for the lack of the current situation of non-coastal provinces,I will give some suggestions about the task of building the legal system of non-coastal provinces in the Bohai Sea Environmental Protection.
