Objective With the rapid development of global economy and society, environmental pollution has become increasingly prominent, which makes the incidence of group health damage growing fast. Environmental pollution lawsuits have increased year after year, and the urgent problem is the assessment of causality. Because environmental pollution is complexity and diversity and health hazards have serious consequences in China, this paper proposes some scientific procedures and methods to assess the causal relationship between pollution and health damage which bases on the new theory and practice cases, in order to form a set of practical causality assessment system for the integration of judge and medicine. These can guide practical work scientifically and protect the people's living environment and health.Method Through applying the methods such as literature review, case study and the group discuss, the background of domestic and foreign health damage and the progression of theory of causality assessment were preliminary understood. And then, causal research ideas in epidemiology, endemiology and environmental medicine will be as a starting point. At last, the framework and standards of preliminary causality assessment were proposed, repeatedly modified combined with the advice of experts so that a scientific and reasonable system of causation was formed.Result 1.The development of foreign theory of causality assessment such as probabilism, epidemiological causality and indirect evidence to the contrary were more mature than others. However, these theories were based on the lack of a unified assessment basis; domestic theory of causality assessment derived from existing foreign theories was still immature, because it is lack of legislative support. 2. Definition of causality of environmental pollution and colony health damage was proposed, which was divided into two parts: causality of environmental emission and environmental damage. 3. Propose the basis and procedure of causality assessment and the attribution of environmental pollution damage. The assessment basis as following:①Sequence in time;②Specific pollutants which emitted by sources of pollution can be detected;③Distribution consistency of pollution and damage;④Load level or the incidence of damage is higher than control area;⑤Evidence of toxicology. The attribution of environmental pollution is divided to six levels from highest to lowest, as follows: 100%, 75%, 50%, 25%, 12.5%, 0%. 4. Evaluation of environmental health risk was introduced into causality assessment, and then according to the different health damage, causality assessment was divided into four types: acute health damage causality assessment, chronic health damage causality assessment, public hazard event causality assessment and unexplained health damage causality assessment. And then each type was analyzed according to overall assessment and procedure.Conclusion Causality assessment is the key of environmental pollution lawsuits. We establish a unified scientific causality assessment basis and procedures. They have some operational and practical and can provide a reasonable basis for the future environmental litigation and environmental management. On this basis, we need to reinforce the theory of causality assessment, establish a scientific and rational assessment system, expand the publicity to raise public awareness of rights and promote the active participation of government and improve the legal system.
