Sino-us Economic Law Comparative Study

Because of the differences in the history, culture and economy conditions, there are some differences between China's an America's political system, legal system, specially in economic law field. But China's economic law is not totally different from America's, there are something in common between them based on the intrinsic character of economic law. Though there are differences between China's economic law and America's in some field, such as economic democracy and economic control, the focusing on the justice of competing or the justice of distribution, they are both the harmony of country's visible hand and market's invisible hand and they all have the characters of policy and economy. They all have some advantages and, at the same time, some disadvantages, too. It's coincidence that one's advantage is another one's disadvantage, so they can learn from each other. China's scholars should notice that, when learning from America's economic law, it's very important to recognize the importance of legal transplant and abandon the prejudice of ideology, choose some proper economic laws to develop our socialistic market economy and the standard of people's lives, pay attentions to the adapt of the new law, in that way we can do our best to contribution of legal system and the harmonious society.
