Compulsory Automobile Liability Insurance Act has been taken into effect on July 1st,2006, indicates formal establishment of the legal system of Traffic Compulsory Insurance in China. Until now, it has been practiced for more than four years. In these years, the public and the scholars pay much attention to the issues like the operating conditions of Traffic Compulsory Insurance, the rate structure of Traffic Compulsory Insurance and whether the scope of Traffic Compulsory Insurance's compensation is reasonable.Because of the fundamental purpose of the Compulsory Automobile Liability Insurance system, the rate and the compensation problems have been the focus within so many problems towards Compulsory Automobile Insurance. Only through the appropriate system design and the balance of the interests before the traffic; and rapid, reasonable and fair compulsory insurance payments after the accident, the function of Compulsory Automobile Liability Insurance can be truly achieved. Therefore, the thesis begins with the function of Compulsory Automobile Liability Insurance, analyzing several core issues related with rate and compensation problems and the legislation of advanced automotive industry states, trying to propose some reasonable legislative proposals to the amendment of our traffic insurance system.Expect the abstract, the thesis can be divided into five chapters.Chapter one introduces Compulsory Automobile Liability Insurance and its main characters. Chapter two tells the meaning of the rate and compensation problems to the Compulsory Automobile Liability Insurance. Chapter three states the rate problem of the Compulsory Automobile Liability Insurance. Chapter four is mainly about the compensation problem of the Compulsory Automobile Liability Insurance. Chapter four includes three parts. One part discusses the items and the scope of the compensation; another talks over the direct right to request of the third-party victims. The last part is about the exemptions of the Compulsory Automobile Liability Insurance and the subrogation of the insured. Chapter five presents the supporting system of Compulsory Automobile Liability Insurance system, the Social Assistance Fund system.
