As China's rapid economic development, if the enterprises want to keep survival and development ,they only constantly grow stronger. In order to be able to obtain in market competition advantage, get bigger profit, the enterprise use various beneficial to its own development strategic measure.The price means is the most important, the most commonly used methods. Of course, the most direct sales prices is most attractive to consumers .But during the process ,due to its capital adequacy of some dominance of enterprise , they had sent price may be lower than production cost, this is a kind of unfair restrictions of competition behavior, practice called predatory pricing. This is a kind of need regulation of illegal competition behavior. Now a large presence predatory pricing,regulate this behavior is most important.So this paper will start from the following four parts to he examines, in order to put forward effective method to regulate the behavior.First part: the definition of predatory pricing. This section mainly from China and other countries to the definition of predatory pricing, the characteristic, the nature of a general introduction and grasp.Part two: the overseas practice analysis of predatory pricing. This part of the practice in the United States and the European Union as the research object.Mainly from the legislative model, setting of authority and procedure, cognizance standard aspects of the abroad advanced experience .Then think whether their its legislative mode and determination standards can inspiration to China for reference and transplantation .Part three: he insufficiency of our country present stage of predatory pricing laws and regulations . Because new promulgated the anti-monopoly law, make our country more complete predatory pricing regulation .But for two new regulations issued by the academic circles has not a whole elucidated..This part is to summarized present China's several laws for our current legislation to do a comb, and puts forward some opinions of my own.Part four: perfect our country's predatory pricing legal regulation.
