Kidnapping is a very rampant crime in old China and basically disappeared a long time in the mainlandafter the founding of theRepublic of China, but with the development of reform and opening up,various thought inflow, the kidnapping crime is starting to revive, and the intensified. Kidnapping is a kind of subjective vicious big, bad social influence serious crime, serious threat to people's life and property security, greatly disturbed the normal order of the society. Therefore, the legislature must strengthen legislation, perfecting the relevant provisions of the crime of kidnapping, ensure the healthy development of harmonious society.From a kidnapping legislation beginning, criminal law educational world and practice for the kidnapping of debate and has been incessantly. Especially in China since the existing criminal law enacted, about 239 A person who kidnaps another person with a view of money or hostage shall be sentenced to fixed-term imprisonment of not less than ten years or life prisonment and concurrently to a fine or confiscation of property and if causing death of the kidnapped person or killing the kidnapped person,to death and concurrently to confiscation pf property. A person who steals an infant or a baby with a view of money shall be sentenced in accordance with the provisions of the preceding paragraph. Because, the law itself provisions of fuzziness, coupled with the rapid development of social life, make this clause not only in criminal law educational world exists many disputes in judicial practice, but also produced many applications.Based on the above situation, oneself through reading research on a large kidnapping theory books to criminal law article as the basis, and combined with practical experience, his work on kidnapping making further research, and put forward some reform suggestions.
